These Terms & Conditions govern your use of GameXpert, operated by Eliwilbry Investments, LLC. By creating an account or using the app, you agree to be bound by these terms.
1. About GameXpert
GameXpert is a sport rules training application for players, parents, coaches, and teams, operated by Eliwilbry Investments, LLC. The app supports multiple sports, team management, AI-powered practice results, and player login accounts for children.
2. Eligibility & Parental Consent
Accounts may only be created by individuals aged 13 or older. Parents and legal guardians must create and manage accounts on behalf of children under 13. By creating a child profile, you confirm you are the parent or legal guardian of that child and consent to their participation. Parents may also create a login account for their child (a username and password chosen by the parent) — by doing so, you authorise that child to access GameXpert under the supervision of your account.
3. Information We Collect
For parent/adult accounts: email address, name, sport and league preferences, quiz history, performance data, and optionally a passkey credential stored by your device.
For child profiles (managed by a parent/guardian): a display name freely chosen by the parent — this does not need to be the child's real name — sport and league context, and quiz history and achievements. If a child login account is created, we also store a username and hashed password. We do not collect children's legal names, contact information, photos, or precise location.
For team features: team name, sport, league, roster memberships, and team quiz session results. Team owners control who is on their roster.
4. Child Login Accounts
Parents may create a login account for a child player (username + password). Once created, the child can sign in and take quizzes independently. The child's display name and state are set and controlled by the parent account and cannot be changed by the child. All activity under a child login account is visible to the managing parent. Parents may revoke a child login at any time by contacting support@eliwilbry.com.
5. Teams & Coaches
Users may create teams and invite other users to join via email or invite link. By joining a team, you consent to your player's quiz performance data being visible to the team owner. Team owners are responsible for maintaining accurate rosters and for ensuring that players added to their team have appropriate parental consent.
The Ask GameXpert feature allows logged-in users to ask rule questions via an AI-assisted chat. Ask GameXpert sessions are subject to the same AI-generated content disclaimer in Section 7.
6. Player Sharing
Parents may generate a shareable link for a managed player profile. Anyone who receives and uses that link gains view access to that player's display name, sport, league, and achievement data. You are responsible for controlling who you share these links with. Share links can be revoked by contacting support@eliwilbry.com.
7. AI-Generated Content Disclaimer
Quiz scenarios, rule explanations, Ask GameXpert responses, and player and team practice results within GameXpert are generated using artificial intelligence trained on rules ingested from official league rulebooks. This content:
- Is not official guidance from any league, governing body, or umpiring association.
- May contain errors or omissions — rule interpretations can be complex and subject to change.
- Is intended for training and educational purposes only and should not be relied upon for officiating decisions or protests.
AI-generated practice results and focus challenges reflect patterns in quiz performance data and do not constitute professional coaching advice. Always refer to your league's current official rulebook for authoritative rules decisions. Eliwilbry Investments, LLC makes no warranty as to the accuracy, completeness, or currency of AI-generated content.
8. How We Use Your Information
We use collected information to personalise quiz content, track progress across sports, award achievements, generate AI-powered practice results and focus challenges, and send account-related emails to the parent/guardian's address. We do not sell, rent, or share personal information with third parties for advertising or marketing purposes.
9. Usage Analytics
We use Microsoft Azure Application Insights, a third-party analytics service, to understand how GameXpert is used so we can improve it. This records actions such as which screens are viewed, which features are used, and quiz and game events. Each event is linked only to a one-way, irreversible hashed identifier — never to your name or email. We do not send names, email addresses, dates of birth, photos, or precise location to the analytics service.
For child profiles and child login accounts the same applies: only anonymised, hashed activity data is collected, and no child personal information is sent to the analytics provider. We use this data solely to operate, maintain, and improve GameXpert — never for behavioural advertising — and we do not permit the analytics provider to use it for its own advertising purposes.
10. Children's Privacy (COPPA)
GameXpert complies with the Children's Online Privacy Protection Act (COPPA). For child profiles we collect only a parent-chosen display name, sport/league context, and quiz history. If a child login is created, we additionally store a username and hashed password set by the parent. We also record anonymised, hashed usage analytics for child activity, as described in Section 9 — this hashed identifier cannot be reversed to identify the child and is used only to operate and improve the service, never for advertising. Parents may review, correct, or request deletion of their child's data at any time by contacting support@eliwilbry.com. We will not contact children directly — all communications go to the parent/guardian's email address.
11. Data Retention & Deletion
You may delete your account and all associated data at any time from within the app (Profile & Settings → Delete my account) or by contacting support@eliwilbry.com. Child profiles and child login accounts are deleted when the managing parent account is deleted, or upon a parent's written request. Team data is deleted when the team owner deletes the team. We retain session and quiz history for up to 12 months to support progress tracking.
12. Acceptable Use
You agree not to disrupt or reverse-engineer the app, harvest information about other users, create false accounts, add players to a team without appropriate consent, or allow a child to use the app without proper parental oversight.
13. Intellectual Property
All content within GameXpert — including quiz scenarios, practice results, badge designs, and the app interface — is owned by or licensed to Eliwilbry Investments, LLC and may not be reproduced without written permission.
14. Disclaimer of Warranties
GameXpert is provided "as is" without warranties of any kind, express or implied. Eliwilbry Investments, LLC does not guarantee uninterrupted access or the accuracy of any AI-generated content, practice results, or focus challenge.
15. Limitation of Liability
To the fullest extent permitted by law, Eliwilbry Investments, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the app, or from reliance on any AI-generated content within it.
16. Changes to These Terms
If we make material changes to these Terms, we will notify you within the app on your next login and require your re-acceptance before continuing.
17. Governing Law
These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law principles.
